{"id":9074,"date":"2020-12-14T15:57:07","date_gmt":"2020-12-14T15:57:07","guid":{"rendered":"https:\/\/dataethics.eu\/?p=9074"},"modified":"2020-12-15T13:02:08","modified_gmt":"2020-12-15T13:02:08","slug":"european-ai-is-human-made-fed-and-driven","status":"publish","type":"post","link":"https:\/\/dataethics.eu\/da\/european-ai-is-human-made-fed-and-driven\/","title":{"rendered":"European AI is Human Made, Fed and Driven\u00a0"},"content":{"rendered":"<p><strong>The German EU presidency of the Council hosted an <a href=\"https:\/\/eu2020-bmjv-european-way-on-ai.de\/event\" target=\"_blank\" rel=\"noopener noreferrer\">online conference<\/a> on Monday that stressed the need for a much stronger focus on fundamental rights in the digital age and especially when jumping to AI as a fix to ensure social goods and growth\u00a0now and\u00a0in the future.\u00a0\u00a0<\/strong><\/p>\n<p><span data-contrast=\"auto\">The aspiration is to do AI the European way and to support this endeavor, the EU Fundamental Rights\u00a0<\/span><span data-contrast=\"auto\">Agency (FRA) <\/span><span data-contrast=\"auto\">launched<a href=\"https:\/\/fra.europa.eu\/en\/publication\/2020\/artificial-intelligence-and-fundamental-rights\" target=\"_blank\" rel=\"noopener noreferrer\"> a new report<\/a> on AI and fundamental rights.<\/span> <span data-contrast=\"auto\">The report unveils the use of AI on four areas including social benefits, predictive policing, health and services and targeted advertising<\/span><span data-contrast=\"auto\">.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\"><b>A New Imperative<br \/>\n<\/b><\/span><span data-contrast=\"auto\">As part of his presentation, t<\/span><span data-contrast=\"auto\">he Director of FRA Michael O\u2019Flaherty put forward an imperative that is simple yet pivotal for our approach to<\/span><span data-contrast=\"auto\">\u00a0AI<\/span><span data-contrast=\"auto\">. He did so by stating that AI is human made, human fed and human driven. Having that as a starting point, embracing respect for fundamental rights and ensuring privacy, non-discrimination and access to\u00a0<\/span><span data-contrast=\"auto\">a legal\u00a0<\/span><span data-contrast=\"auto\">remedy\u00a0<\/span><span data-contrast=\"auto\">stand out as the logic consequence when developing AI solutions in democratic societies.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">This way of anchoring fundamental rights and freedoms in the digital age is not new but i<\/span><span data-contrast=\"auto\">ts reiteration i<\/span><span data-contrast=\"auto\">s important in the sphere of AI as discussions on transparency, explainability and foreseeability is often overruled by tech giants<\/span><span data-contrast=\"auto\">\u2019<\/span><span data-contrast=\"auto\">\u00a0and other actors in the AI industry. Arguments of black box<\/span><span data-contrast=\"auto\">-technology<\/span><span data-contrast=\"auto\">, lack of knowledge or the use of non-disclosure-agreements are\u00a0<\/span><span data-contrast=\"auto\">thus<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">used to stall requirements for insight by public sector, NGOs<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0and academia.\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\"><b><span lang=\"EN-US\">Oversight and Accountability<\/span><\/b><br \/>\nThe alleged opacity of algorithms hinders built-in safeguards for non-discrimination, freedom of expression, association, movement<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">the right to education, housing, work and social benefits,\u00a0<\/span><span data-contrast=\"auto\">and consumer rights,\u00a0<\/span><span data-contrast=\"auto\">and holds as such a high risk for setting aside\u00a0<\/span><span data-contrast=\"auto\">the effective protection of fundamental rights.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Against this background, many speakers presented\u00a0<\/span><span data-contrast=\"auto\">concrete proposals for\u00a0<\/span><span data-contrast=\"auto\">new\u00a0<\/span><span data-contrast=\"auto\">legal obligations<\/span><span data-contrast=\"auto\">\u00a0supplementary to those found in the GDPR.\u00a0<\/span><span data-contrast=\"auto\">They included for example mandatory fundamental rights impact assessments and strengthe<\/span><span data-contrast=\"auto\">ned<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">bodies to ensure effective oversight and accountability. This role could easily be vested in existing structures, such as National\u00a0<\/span><span data-contrast=\"auto\">Equality Bodies and National Human Rights Institution<\/span><span data-contrast=\"auto\">s.<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><b><span lang=\"EN-US\">A Need For Impact Assessment<br \/>\n<\/span><\/b><span data-contrast=\"auto\">To that end a <a href=\"https:\/\/www.humanrights.dk\/publications\/human-rights-impact-assessment-digital-activities\" target=\"_blank\" rel=\"noopener noreferrer\">new practical guideline for business<\/a> and other actors in the digital eco-system deserves attention.\u00a0<\/span><span data-contrast=\"auto\">The guideline<\/span><span data-contrast=\"auto\"> was launched by the Danish Institute for Human Rights<\/span><span data-contrast=\"auto\">\u00a0in November\u00a0<\/span><span data-contrast=\"auto\">2020\u00a0<\/span><span data-contrast=\"auto\">with the purpose of providing the private sector with tools to perform\u00a0<\/span><span data-contrast=\"auto\">human rights\u00a0<\/span><span data-contrast=\"auto\">impact assessment<\/span><span data-contrast=\"auto\">s<\/span><span data-contrast=\"auto\">\u00a0when developing, deploying and procuring digital and AI based products and solutions<\/span><span data-contrast=\"auto\">.
